A case known as the Vishaka vs State of Rajasthan created major changes in this. This case is about a social worker who faced serious harassment while doing her work.This matter is handled by the Supreme Court of India. An important decision in this case was given by the Supreme Court in 1997. The court noted that to work with dignity and safety is a basic right of a woman. For the prevention of sexual harassment at the workplace some rules named the Vishaka Guidelines were established . The employers followed these guidelines before proper law was made. There was a need for a strong and clear law after this. The government noted this issue and finally made a law in 2013 called the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, which is also known as the POSH Act.

POSH Act applies to many workplaces including offices, companies, schools, hospitals, and shops. The workplace must make sure that women are treated with respect and dignity.
WHAT IS SEXUAL HARASSMENT?
Unwanted behaviour that makes a woman feel uncomfortable, scared or insulted that called sexual harassment. This can include bad comments, touching without permission or asking for physical favors in a wrong way. If a woman faces sexual harassment at the workplace then the POSH Act protect her.
Internal Complaints Committee
Workplace which has ten or more employees, then it must create a committee named the Internal Complaints Committee according to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. Women facing harassment at work can complain to the Internal Complaints Committee. Committee looks into the complaint and tries to solve the problem in a proper way. The committee usually consists of: A senior woman employee who acts as the Presiding Officer Two employees who have experience in social work or knowledge of issues relating to women An external member from an NGO or organisation working in the field of women's rights
Proceeding for Making a Complaint
Women should not stay silent when she face harassment at the workplace. woman has the right to complain and seek help under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. Step 1: Make a Complaint Women can make a complaint to the Internal Complaints Committee. In writing the complaint should be made. It must clearly explain what happened. Step 2 : Time Limit The complaint should be made within three months from the date of incidents. If there is any valid reason for delay then the Committee may allow more time. Step 3 : Help in Writing Complaint The committee can help the woman write the complaint if the woman is not able to write the complaint. Step 4 : Inquiry made by the Committee After receiving the complaint the internal committee will start an inquiry. The internal committee checks the facts carefully after listening from both sides. Step 5 : Mediation (optional) The woman can ask for a settlement through conciliation before starting the enquiry. The settlement in the form of money is not allowed in this process. Step 6 : Action and Decision The decision after the inquiry will be given by the Committee. Proper action will be taken against the wrongdoer if the complaint is found to be true. Step 7 : Confidentiality Details of the complaint are kept confidential. This means the information is not shared with others.
Consequences of Violating the Law
Conclusion made by Internal Complaint Committee that sexual harassment has occurred at the workplace. It may take the necessary steps against the responsible person or persons. These actions can vary depending on the seriousness of the misconduct and may include a written apology, warning, deduction of salary as compensation, suspension or termination from employment. Organizers or employers of an establishment hold responsibility according to the law. If an establishment fails to comply with the rules of the POSH Act such as failing to form an Internal Complaints Committee (ICC), Establishment may be required to pay a penalty of up to ₹50,000. If these violations continue then it can lead to cancellation of licenses.
