Dear Client,
Based on the facts provided, if the proposed Harimandir is being constructed on a public/village road or government land and would reduce the usable road to only about 8 feet, the matter should be taken up immediately on public-safety grounds, particularly because emergency vehicles such as ambulances and fire services may be unable to reach the affected houses. You should submit a written joint complaint signed by the affected villagers to the Circle Officer/BDO, local police and the concerned Panchayat/local authority, requesting immediate inspection and measurement of the road and removal/prevention of any encroachment. Take photographs/videos showing the present road width and proposed construction and keep copies of all complaints with receiving acknowledgements. You can also submit the grievance through the appropriate Jharkhand government grievance system. If the authorities do not take action, you should consider approaching the appropriate civil/revenue authority or court seeking directions to protect the public access road. The exact remedy will depend on whether the land is recorded as a public road, government land, Panchayat land or private land.
You may opt for a one-on-one consultation with our office.
Hope this clarifies your position.
