► Hello, I am Orsan Dodiya and I work at Swastik Engitech. My question is: my joining date was 27-02-2023, but at that time the company did not provide me with an offer letter or appointment letter. After one year, as per my personal requirement, I requested the offer letter, and the company provided it to me. Later, on 30-05-2025, I submitted my resignation letter giving a one-month notice. The company is now claiming that, according to the offer letter, I should have served a three-month notice period. During that time, I had already informed the HR department personally via WhatsApp that I was not able to serve a three-month notice period. The HR department also communicated this to the management, and in response, HR told me that it was okay. After that, I left the company on 26-06-2025. The company had also put my salary on hold, due to which I had to approach the Labour Court to recover my salary, and the case was closed. Now, the company has sent me a legal notice claiming that I did not serve the three-month notice period as per the offer letter. What should I do next regarding this?

If your offer letter/appointment letter or service rules has clause of three months notice period then you are legally bound to serve three months notice period. In alternate you can buy this notice period subject to terms and clauses of offer letter/appointment letter.
