► I made an online purchase via Instagram and paid through UPI. Due to delay and lack of tracking, I filed a cyber complaint. Later, the seller said the product is dispatched and asked me to withdraw the complaint. I have withdrawn it online, but the bank amount remains frozen. The seller says her lawyer advised that matters may worsen if I do not submit a written application at the police station. I want to know what legal risk, if any, I face.

Dear Client, as per your query, There is no major legal consequence in filing a complaint in good faith based on a tracking delay. There are no penalties if you remove your complaint once you are satisfied. However, the bank account remains frozen as the National Cyber Crime Reporting Portal (NCRP) will have automatically flagged the account. Removing this "freeze" from your account is a process, which may require a formal No Objection Certificate (NOc) from the police to the bank, even after an online withdrawal. While not necessary from a legal standpoint, going down to the police station to file a statement or affidavit may be the best course of action to speedily confirm your settlement, which will enable the police to officially inform the bank to unfreeze your account. There may be a reason why the seller is pressuring you to file a closure statement, which may be because they need access to your account. (mention Complaint No. / Acknowledgment No.)

State:

You made the complaint due to delay

Seller has now claimed dispatch / resolved the issue

You have withdrawn the complaint online

Request formal closure and issuance of defreeze instruction to bank.

 

Is there any legal risk to you?

Answer: NO, provided your complaint was genuine.

Why there is no risk:

You paid money through UPI for a product.

There was delay + no tracking, which gives a reasonable cause to complain.

You did not fabricate facts or lodge a false FIR.

You withdrew the complaint once the seller claimed dispatch.

Dear Sir, as per your query,

 

Give a simple written application to the cyber police station / cyber cell referencing your complaint ID, stating you have withdrawn the complaint as the seller claims dispatch.

Email the bank’s grievance/cyber cell attaching the withdrawal acknowledgment and your application.

Do not sign any settlement admitting fault or wrongdoing, only say “matter resolved / withdrawn"
