Dear client,

If a boy has a physical relationship with a girl by promising to marry her, but later refuses to marry, the girl can take legal action. If the promise was false from the beginning and made only to get physical with her, then it is not real consent. In that case, it can be treated as rape under Indian law. The girl can file a police complaint and show proof like chats, messages, or witness support. But if the boy truly wanted to marry and things didn’t work out later, it may not be considered a crime. The court will look at the intention behind the promise.

I hope this answer helps, in case of further queries, please dont hesitate to reach out to us.

No case and crime is made out if two adults voluntarily have enjoyed sex. Section-69 BNS does not get attracted.

To, The Station House Officer [Name of Police Station] [Full Address] [City, State, PIN Code] Date: [DD/MM/YYYY] Subject: Complaint under Section 69 of the Bharatiya Nyaya Sanhita, 2023 – Sexual Intercourse on False Promise of Marriage Respected Sir/Madam, I, [Your Full Name], daughter of [Father’s/Mother’s Name], aged [Your Age], residing at [Your Complete Residential Address], respectfully submit this complaint for your immediate attention and necessary action. I wish to file a criminal complaint against [Accused's Full Name], son of [Father’s Name], residing at [Accused’s Address if known], for committing the offence of obtaining sexual intercourse by deceitful means, in particular, through a false promise of marriage, which squarely falls under the provisions of Section 69 of the Bharatiya Nyaya Sanhita, 2023. The facts of the case are as follows: That I came into contact with the accused in or around [Month, Year], and we gradually developed a close relationship. That during the course of our relationship, the accused repeatedly assured and promised me that he would marry me. On the strength of these promises and in good faith, I consented to engage in sexual relations with him on multiple occasions. That I now have reason to believe and have evidence to prove that the accused never had any genuine intention to marry me and made such a promise solely to exploit me sexually. That when I insisted on marriage, the accused began to avoid me, abused me verbally, and finally refused to marry me, causing immense emotional, mental, and physical trauma. That I have now come to know that the accused was either already in a relationship with another woman or had no intention of fulfilling the said promise from the very beginning, thereby misleading and deceiving me. That this conduct amounts to an offence under Section 69 of the Bharatiya Nyaya Sanhita, 2023, which punishes deceitful sexual intercourse, including by a false promise of marriage. I request you to kindly register an FIR against the accused and initiate appropriate legal action under the relevant provisions of the law. I am willing to cooperate fully in the investigation and provide all supporting evidence, including messages, call records, and witnesses. I am enclosing herewith copies of relevant documents and any available evidence that may assist the investigation. Prayer: You are therefore requested to take cognizance of the matter, register my complaint as an FIR under Section 69 of the BNS, 2023, and take necessary legal action against the accused to ensure that justice is served. Thank you. Yours sincerely, [Signature] [Your Full Name] [Mobile Number] [Email Address, if any] Enclosures:
