Legal Remedies Available:

1. File a Representation to the Department (First Step)

– Submit a formal written representation citing:

The original advertisement clearly stating 4600 grade pay,

Your appointment letter (if it also reflects 4600 GP),

And request withdrawal of the downgrade order.

2. Approach the Himachal Pradesh Administrative Tribunal (if active) or High Court

– File a writ petition under Article 226 of the Constitution for:

Quashing the downgrade order, and

Restoring the original grade pay as per advertised terms.

3. Grounds for Legal Relief:

Violation of principles of natural justice (no prior notice or hearing),

Breach of legitimate expectation (you joined on the promise of 4600 GP),

Arbitrary administrative action without lawful justification.

4. Seek Interim Relief

– In your petition, request that the lower grade pay not be enforced until the case is decided.

Personal perception:-

“This is a strong case of unfair downgrading after appointment. I’ll help you file the right petition so your grade pay is restored, and your seniority or financial benefits are protected. Let’s act fast — once I take over, we’ll ensure justice without delay.”

Dear client,

If your appointment was made with 4600 grade pay as written in the job advertisement and appointment letter, then changing it later to 3800 is not correct. It is a violation of service rules and your legal rights as a government employee.

First, you should collect all documents like the job advertisement, appointment letter, salary slip, and the order which changed your grade pay. Then, send a written complaint or representation to your department head asking for correction.

If they do not respond or reject your request, you can file a case before the Himachal Pradesh Administrative Tribunal or the High Court. The law protects government employees from such unfair changes. You can say this is a breach of promise and also against natural justice.

You should immediately submit a written representation to your department, stating that your appointment was made on a Grade Pay of ₹4600 as per the advertisement and offer letter. Downgrading your pay to ₹3800 after one year is arbitrary, violates the terms of appointment, and breaches principles of natural justice. Request restoration of ₹4600 Grade Pay with all consequential benefits. If unresolved, you may file a complaint before the Himachal Pradesh Administrative Tribunal or approach the Hon’ble High Court under Article 226. Keep all relevant documents safely. Legal recourse is well-supported in such service matters.

Dear Sir, File a Complaint with the State Administrative Tribunal / High Court If the department rejects your request or doesn't reply within a reasonable period (usually 30–60 days): Himachal Pradesh State Administrative Tribunal (HPAT) (if functioning): File an Original Application (OA) under Section 19 of the Administrative Tribunals Act, 1985

Dear client, from the above question it is evident that the release order reduced your salary. I advise you to kindly go through your terms of appointment and the release order to understand whether the government is empowered to do the same. If they have acted in an arbitrary or did not comply with the laid down -procedure then we can file a writ petition to void the release order. Since, the notification is not disclosed, this is all I can advise you to do. Kindly contact us for further discussions to resolve your dispute.
