► y brother bought a flat near Mira Road and won the MahaRERA Case against the builder/Promoter for he had delayed the flat possession. Hon'ble Maharera (Authority) ordered payment of interest till he gave possession of the flat with OC. The builder filed an appeal at MahaREAT and paid a deposit under section 43/5. He lost the appeal and the deposited money was given to my brother. Then the Promoter went to Bombay High Court where the Court upheld the Maharera and Mahareat Order. So the Promoter has gone to contest the appeal further at the Supreme Court against the order in second appeal at Bombay High Court. Whereas my brother has filed a non Compliance of order at Maharer authority. And MahaRer Authority has passed on the execution to the Adjudicating officer (AO) as the power is delegated to Adjudicating officer (AO) under circular no. 146 which is not declared in public domain. My brother wants to apply with the Authority to transfer the Execution from AO to the Authority as according to RER Act and Newtech order the power to execute the order lies with the Authority and AO has no jurisdiction to Execute the order.
What should be the title of document being given to the Hon'ble MahaRERA Or AO?
