2.    Emotional and Mental Abuse

People do not always talk about the emotional and mental abuse in households, and ignore it because it leaves no visible marks, but emotional and mental abuse can be more harmful than physical abuse, because it can deeply affect the person’s confidence and mental health. This kind of abuse includes constant insults, threats of divorce, humiliation in front of the public or others, character assassinations and controlling daily life. 3.    Verbal abuse

5.    Economic abuse

Most of the women in India are financially dependent on their husbands, which might cause economic abuse. This abuse happens when the husband controls money and refuses to give any access to his wife, not even for basic needs. This includes not giving money for food or medicine, stopping her from working, taking all her earnings and controlling her financial decisions. Economic abuse leads to dependency and makes it harder for the wife to get out of this situation.

Causes of Domestic Violence in India

1.    Patriarchal society

In India, many families still follow the patriarchy, where males are dominant and consider themselves superior and expected to be obeyed. This unequal power and discrimination between the male and female members of the family lead to domestic violence.

2.    Dowry demands

Dowry is still a major issue in India, which causes domestic violence. Many women are harassed, tortured, or even killed because of dowry demands. Even though dowry is stated as a criminal offence in India, the cases of dowry deaths are still seen and have not decreased yet.

3.    Lack of Education

Lack of education affects the prevention of domestic violence. The victims are still unaware of their rights and equality, which makes the problem worse. Many women still do not know that what they are facing is actually domestic violence because of their lack of knowledge and education.

4.    Financial dependency

Women who are completely dependent on their husbands financially face domestic violence, and it makes it difficult for women to leave an abusive relationship.

Laws protecting women in India

 

India has introduced several laws protecting women from domestic violence. The following are the laws:

1.   Protection of women from domestic violence, 2005

The Protection of Women from Domestic Violence,2005, was introduced to protect women from domestic violence. This is the main law governing the protection of women from all forms of abuse, not just physical violence.

The following are the relief available from domestic violence under this act:

·      Protection from Further Violence

Section 18 of the Protection of Women from Domestic Violence Act, 2005 covers the Protection orders that the court may prohibit the respondent from committing further acts of violence or harassment.

·      Right of residence

Section 19 of the Act covers residence orders that the court may make to ensure that the woman is not unlawfully removed from the household.

·      Monetary relief

Section 20 of the Act covers monetary relief, in which the financial assistance may be granted for maintenance, medical expenses, and other losses suffered due to domestic violence.

·      Custody order

Section 21 of the Act covers custody orders in which temporary custody of children may be granted when required.

·      Compensation Orders

Section 22 of the Act covers the compensation orders in which compensation may be awarded for mental trauma, emotional distress, and injuries suffered by the victim.

·      Interim orders

It is mentioned under Section 23 of the Act, where the court may grant immediate temporary relief in urgent situations.

2.   Dowry Prohibition Act,1961

The Dowry Prohibition Act,1961, was introduced for the prevention of dowry and also highlights the punishment regarding dowry cases. This law prohibits the giving and receiving of dowry.

Most of the domestic violence cases are related to dowry demands; this act applies to such cases. The Dowry Prohibition Act,1961 and the Protection of Women from Domestic Violence Act,2005, work together to prevent harassment related to dowry demands and also provide relief to the victims.

These laws are supported by Section 498A of the Indian Penal Code, which is now Section 85 of the Bharatiya Nyaya Sanhita,2023 imposes strict prison sentences on husbands and in-laws if they treat a married woman with cruelty. Cruelty includes physical violence, mental torture, heavy pressure and harassment to force her or her family to give dowry.
